Should Kaepernick not be protesting the National Anthem?

Over the past few weeks, Colin Kaepernick has continued to display his protest of the National Anthem despite the overtly negative reaction from media organizations and public opinion.

Opinions are our own, but some of them could be related to the very issue that Kaepernick wants to direct attention towards. Similar to tweets such as...


These are four points to consider when discussing Colin Kaepernick's protest.

1) Kaepernick has the Constitutional right to do so.

(Freedom of the right to petition), noun, freedom of the right to challenge, freedom of the right to oppose, freedom of the right to speak out.

Our constitution specifically states that Kaepernick has the right to "peaceful protest", or how Burton's Legal Thesaurus put's our First Amendment, "freedom of the right to speak out".

So immediately, off-the-bat, anyone who says that Kaepernick should not be able to conduct a peaceful protest of "police brutality" and "racial inequality" is in violation of the same constitution that our military fights for.

"I have great respect for men and women that have fought for this country. I have family, I have friends that have gone and fought for this country. They fight for freedom. They fight for the people, they fight for liberty and justice for everyone. And that’s not happening. People are dying in vain [at home] because this country isn’t holding their end of the bargain up." - Kaepernick


President Obama has also been cited as supporting his cause:

�"But my understanding, at least, is that he's exercising his constitutional right to make a statement. I think there's a long history of sports figures doing so." –President Barack Obama

and....

"But I don't doubt his sincerity. I think he cares about some real, legitimate issues that need to be talked about and if nothing else what he's doing has generated more conversation around some topics that need to be talked about." –President Barack Obama

2) Racial Inequality and Police Brutality

First of all, lets take a look at some detailed specific percentages concerning police brutality.


There are definitely issues within our justice system, and I do believe that a majority of our law enforcement officials are genuinely good people, but statistics don't lie! An issue is there, and will continue to be an issue until it is completely eradicated.

"The [U.S.] has elected a black president. But there are also things—a lot of things—that haven’t changed. There are a lot of issues that still haven’t been addressed. And that’s something over an eight-year term, there’s a lot of those things that are hard to change and there’s a lot of those things that he doesn’t necessarily have complete control over." -Kaepernick

Another main point of interest concerning police brutality/racial inequality are cases such as Trayvon Martin, but below are names of people that have been in similar situations.

Dontre Hamilton, Eric Garner, John Crawford III, Micheal Brown Jr, Ezell Ford, Dante Parker, Tanisha Anderson, Tamir Rice, Rumain Brisbon, Jerame Reid, Tony Robinson, Phillip White, Freddie Grayand many others throughout the years have been slaughtered without proper justice being served, and in several cases the officers accused of these crimes have been given paid leave while the investigation is going on.

Kaepernick did not speak without doing his research, his comment here pretty much sums it up...

"There are bodies in the street and people getting paid leave and getting away with murder," -Kaepernick

3) Many other athletes have protested in similar ways.

"I cannot stand and sing the anthem. I cannot salute the flag. I know that I am a black man in a white world." - Jackie Robinson

"Tommie Smith and John Carlos, raised their fists in a black power salute during a medal ceremony at the 1968 Olympics in Mexico City as the anthem was playing. "

"Former Cleveland Cavaliers player Dion Waiters refused to be on the court for the anthem in 2014. And Denver Nuggets player Mahmoud Abdul-Rauf courted criticism after he deliberately sat during the anthem in 1996. "

The gravity of the situations are different for every individual's demonstration, but the message has been the same. The amount of injustice or when it occurred is irrelevant, the fact that it exists is the true problem which needs to be addressed.

4) The National Anthem itself contains an outdated, racist atmosphere .

"Their blood has wash'd out their foul footstep's pollution.

No refuge could save the hireling and slave

From the terror of flight or the gloom of the grave,"

These lines are from the third verse of "The Star-Spangled Banner", our national anthem. Scholars have discussed the language used to try and pinpoint what the connotation and meaning behind the words used.

"Some interpretations of these lyrics contend Key was in fact taking pleasure in the deaths of freed black slaves who had decided to fight with the British against the United States."

Ever since 1931, when "The Star-Spangled Banner" became the United States national anthem, there has been dialogue surrounding the implications of the song as a whole and why as Americans would want to associate themselves with potentially racist language.

Songs such as: "America the Beautiful" or "God Bless America" have been the songs that have been submitted to possibly replace "The Star-Spangled Banner".

To me, a symbol of our country should have absolutely no indications of inequality or immoral/unethical implications.
