The Nazgul And The Tyranny Of The Supreme Court

"Law" and "Order", these are the values that pride themselves in the political fabric of our courts, where justice may be upheld and crime be punished within the confines of the Constitution. Indeed, the Supreme Court, perhaps one of the greatest achievements of the Framers of the Constitution, was designed to be one of the strongest beacons of freedom by taking the mantle of being a pivotal "check and balance" in our federalist system of government.

The adjudication by nine appointed justices would provide the ultimate oversight of any legislation passed by the legislature and any executive action passed by the executive branch; that any policy and statute may not circumvent the liberties granted to the citizen within the Constitution. Although the smallest branch, the judiciary would prove throughout the 239 year existence of the United States that its power of oversight would prove crucial. But also, throughout history, it is within these shadowed courts of law where some of the greatest affronts of tyranny may be discovered.

The purpose of the Supreme Court was to interpret the law of the land and strike down any move of the government that infringes upon its sanctity. However, as the years progressed and the arm of the government has stretched beyond its Constitutional confines, the court that was designed to be the epitome of justice has now turned its attentions to a ravenous consumption of immeasurable power in using its power to create law and dictate it to the populace.

The idea that the opinions of 9 fallible justices in black robes could be given so much weight in deciding policy rather than interpreting the law as was its initial function borders on oligarchic rule.

In the fecklessness of the current and and recent administrations, more attention is given over a decision by the Supreme Court than statutes that are actually legislated by Congress. These "decisions" have now become the validation for government consumption of power as opposed to being the condemnation; and in doing so making 9 opinions "the rule of law" upon which all lower courts, state legislatures and assemblies must follow in direct abridge to the very Constitution that the justices swore to uphold.

It was because of such potential for oligarchic rule in judicial oversight that the Framers drafted the 10th Amendment to complete the 10 original Amendments that were included within the rubric of the Constitution:

" The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

It is no wonder then, that such violations of purpose serve as indicators of a government that has joined forces to strip liberty out of the hands of governed, abridging the cardinal ethic that "the government governs only at the consent of the governed". Decisions by the Court in some of the most landmark cases were designed to provide precedent which the appellate and district courts could use to come to case decisions as opposed to dictation, but unlike the socialist's argument, the opinions of the highest court could be ignored by the state.

But in a brilliant "Alinskyite" manipulation of power in the landmark decision in MucCulloch v. Maryland, the judiciary branch granted Washington D.C. federal oversight over the states and granted Congress ambiguous "implied powers" that increased the power of governmental leverage over the states, stripping away state sovereignty by force.

The astounding fact that such a tribunal could abuse cases of grievance in order to consolidate its own power and the ravenous hunger thereof completely negates the purpose of federalist government, for in a few years, the Supreme Court compounded the trend for power consumption in Cohen v. Virginia which gave itself the implied right of judicial review in maintaining jurisdiction to declare state laws unconstitutional.

But when the citizen refuses to become even the least bit educated about his own freedom, and the threat to abridge it thereof, the intellectual forces of tyranny that drive the actions of a government consumed with its own clout does everything to indoctrinate the citizen with the apparent necessity of "revoking freedom". Upon such negligence, power becomes ripe for the taking, and we allow these 9 Wringraiths of the Nazgul to adjudicate policy from their polished thrones, and it only becomes a matter of time before these unelected officials begin to dictate philosophy and thereby shape the opinions of its own people through judicial fiat.

As the 16th President of the United States Abraham Lincoln once said, "...the candid citizen must confess that if the policy of the government, upon vital questions, affecting the whole people, is to be irrevocably fixed by decisions of the Supreme Court, the instant they are made, in ordinary litigation between parties, in personal actions, the people have ceased to be their own rulers, having, to that extent, practically resigned their government into the hands of that eminent tribunal.

The trends of government overreach that have betrayed liberty are to be most feared in the hands of a higher court that is beyond the threat of any election or term limit. Like the 9 ringwraiths known together as the Nazgul displayed in J.R.R. Tolkien's iconic novel series The Lord of the Rings that were beholden only to the ring master Sauron who was increasing his power and strength to unleash world domination over Middle-Earth, the Judiciary branch, in this post-constitutional era, is now only known to be beholden to the ideal of centralized power and control in Washington D.C.; er go, societal domination.

Once the judiciary solidified control, it wasn't long before the state courts began to follow suit and begin dictating policy to constituents in a gross violation of their constitutional authorities. One such example is found in the The Supreme Court of Nevada during the 1990s, when voters achieved passage of an amendment to the state constitution that required a two-thirds super-majority in the state legislature before any tax increase may be initiated. Against the will of the people, the Supreme Court of Nevada struck down the amendment and legislated that only a simple majority would be required to pass $1,000,000,000 in tax increases.

The Framers of the Constitution, above any other threat of tyranny, feared the increase of power from the courts because it was this branch's independence from the people that could embolden the 9 appointees to engage in a judicial activism that would desecrate the separation of powers, of which strong "checks" against the courts' jurisdiction were instituted in Article 3, Section 2 of the Constitution.

As renowned Framer of the Constitution and Third President of the United States Thomas Jefferson once said, " The judiciary of the United states is the subtle corps of sappers and miners constantly working underground to undermine the foundations of our confederated fabric. They are construing our constitution from a co-ordination of a general and special government to a general and supreme one alone. This will lay all things at their feet, and they are too well versed in English law to forget the maxim, ‘boni judicis est ampliare jurisdictionem’ [good judges have ample jurisdiction]. . . . A judiciary independent of a king or executive alone, is a good thing; but independence of the will of the nation is a solecism, at least in a republican government."

What should have been the epitome of justice has become the epitome of despotic jurisprudence with no one nor anything to hold the Nazgul to account, and in such ignorance we allow "Sauron" (the federal government) to increase in his strength.

The idea that any citizen can make the miscalculated assertion that legislation can be justifiably dictated by 9 unelected despots reflects the greatest idiocracy; moreover, that a justification can be made for philosophy and perceptions of reality to be determined or altered absolutely by judicial opinion.

Has society unraveled so quickly that the surrendering of every liberty to some higher authority of corrupt individuals has become the norm? It is demeanors and doctrine like this that has lead to the rise of despots like Hitler, Stalin, Ferdinand Marcos, Hugo Chavez, Fidel Castro, Mao Zedong, Vladimir Putin, Kim Jong Il and many more. This environment of complacency with the current state of the union lays perfect ground for the government to continue to take freedom away from the people, and to seal such attempts through the Supreme Court and its 9 ringwraiths.

The Framers of the Constitution installed the separation of powers in order to curb themselves from being infiltrated by despotism, with the three branches of government maintaining co-equal powers to restrain each other from rising above Constitutional boundaries, which makes their collusion in today's society the greatest threat to freedom and liberty. And it is probable that the Judiciary branch of government, once deemed the ultimate authority on interpretation of constitutional law, has become the most dangerous of the three branches. "Law" and "Order" in every sense of the words in this society have become a bad joke.

As Thomas Jefferson concluded, " Nothing in the Constitution has given them [the federal judges] a right to decide for the Executive, more than to the Executive to decide for them. . . .The opinion which gives to the judges the right to decide what laws are constitutional and what not, not only for themselves, in their own sphere of action, but for the Legislature and Executive also in their spheres, would make the Judiciary a despotic branch."

In Biblical teachings, the idea of a checked and balanced government can be traced directly to Isaiah 33:22,

" The Lord is my Judge (The Judiciary), the Lord is my Lawgiver (The Legislature), and the Lord is my King (The Executive), it is he who will save us."

And in 2 Timothy 2:13,

" If we are faithless, he remains faithful, for he cannot disown himself."

Both of these verses point to checked and balanced power, for if God is indeed our Judge, then he cannot disown himself as the Lawgiver; and as the Lawgiver he cannot disown himself as the King. And while there have been numerous attempts to undermine this protectionist system of liberty, emulating our present unfaithfulness to our own principles, the American idea still stands today under the ongoing assaults.

No, the Nazgul does not have the final word nor maintains a monopoly on the Constitution and nowhere in the reasoning of the Framers can such justification for judicial tyranny be found. For what greater judge do we answer to but that of the absolute moral principles that founded this great nation and the liberty upon which it was built? I challenge you to find anything that excels this in plausibility.

If it were up to this humble writer, I would see to it that these 9 fallible justices in black robes finally be held to the people's account and strip executive influence from the decisions of the court. If there is to be true justice in our court system, then we as the citizens must demand it against the political rhetoric of tyranny and become educated of the unforeseen devices of evil that would seek to utilize judicial opinion to shape the moral, political and legal conditions of the constituency absent the oversight of Constitutional law itself.

The Supreme Court may be considered as the authority of interpretation on the Constitution by the politicians and the main-stream media, which means that they are certain to be aware that the Constitution is likewise the greatest weapon that can be used against it, driving the political elite to indoctrinate the proceeding generations into eventual foolishness, that it will never be able to recognize the weapon that they have been given as a people in defending freedom. For there is nothing a federal government fears more than an armed populace, not only in physical faculties but also in the powers of the mind. As Adolf Hitler himself once said, " Weakness will be knocked out of them. A violently active, dominating, brutal youth – that is what I am after. Youth must be indifferent to pain. There must be no weakness and tenderness in it. I want to see once more in its eyes the gleam of pride and independence of the beast of prey. I will have no intellectual training. Knowledge is ruin to my young men.I would have them learn only what takes their fancy."

As patriots to our homeland, our liberty only ceases in death. And as patriots we must seek to fulfill our ultimate duty to obtain knowledge of the Constitutional boundaries that prevent freedom's abridging. It starts with knowing the true meaning of justice and freedom in the Constitution, for to have a lack of knowledge of both indicates an inability to defend them. For "Justice", "Freedom", "Law" and "Order" are all ordained by Almighty God himself as unalienable principles of the liberated society, and to surrender any of them to independent tribunals in government would prove to be the greatest apostasy to our free nation.

As God says himself in Isaiah 61:8-9

" For I, the LORD, love justice; I hate robbery and wrongdoing. In my faithfulness I will reward my people and make an everlasting covenant with them."

Don't wait in fear for the dictations of the Nazgul. Rather, increase in knowledge that you may be fully equipped to stand strong and hold these "Servants of Sauron" in contempt of the law they swore to protect. Under the authority given to you by the Constitution as the free and liberated people of this great nation, it is so ordered...
